When You Need an Attorney for Disability Retirement — and When You Don’t

There is no universal answer

An initial FERS disability application can be filed by the applicant. Hiring an attorney is a personal decision that depends on the facts, ability to manage the process, and need for legal advice. An initial application can involve legal issues even if no denial has been issued.

Situations where legal advice may be especially useful

Read each decision immediately. OPM reconsideration and MSPB appeal deadlines use different rules. Retaining a professional does not by itself extend a deadline.

What representation means

MSPB allows self-representation and representation consistent with its rules. It is inaccurate to say every reconsideration or appeal must legally be handled by an attorney. A qualified attorney can provide legal advice and representation within the agreed scope; ask about experience, fees, services included, and who will handle submissions.

What education can provide

Process education can help you understand current OPM instructions, collect records, and organize your own materials. It does not substitute for legal advice or determine your eligibility. No consultant should promise that a straightforward application is automatically easy or that representation is unnecessary for every initial claim.

TFDR's scope

TFDR is an independent non-attorney consulting business. Its current services are described on the services page. TFDR does not provide legal advice, represent applicants before OPM or MSPB, or handle reconsideration and appeals. Choose qualified counsel when you need legal analysis or representation.

Independent educational content only. TFDR is not a law firm or federal agency. No legal advice or outcome guarantee.
